WesterNet Customer Policy: Spamming and Abusive Internet Behavior WesterNet provides to business and consumer users several information technology related services, including such services as Internet access, electronic (email) mail and other online and Internet-related services. It is contrary to WesterNet policy for any user of these services to effect or participate in any of the following activities through a WesterNet-provided service: 1. To post a single article or advertisement to more than ten (10) Usenet or other newsgroups, forums, email mailing lists or similar groups or lists. 2. To post to any Usenet or other newsgroup, forums, email mailing list or similar group or list articles which are off-topic according to the charter or other owner-published Frequently Asked Questions FAQ's) or description of the group or list. 3. To send unsolicited mass emails to more than twenty-five (25) email users, particularly if such unsolicited email provoke a complaint. 4. To engage in any of the aforementioned activities using the service of another provider, but channelling such activities through a WesterNet account or remailer, or using a WesterNet account as a maildrop for responses. 5. To falsify user information provided to WesterNet or to other users of the service in connection with use of a WesterNet service. 6. To gain access to any other machine attached to the WesterNet service, or attempt to do so, without the specific knowledge and permission of the owner. WesterNet considers the above practices to constitute abuse of our service and of the recipients of such unsolicited mailings and/or postings, who often bear the expense of these practices. Therefore, these practices are prohibited by WesterNet's terms and conditions of service. Engaging in one or more of these practices will result in immediate termination of the offender's account and/or denial of future access to WesterNet services, without recourse or refund. In addition, WesterNet reserves the right to implement technical mechanisms which block multiple postings as described above before they are forwarded. This policy addresses only the kinds of network abuse specifically enumerated above. In addition to these activities, WesterNet's terms and conditions of service also prohibit other forms of abuse such as harassment and the posting of illegal or unlawful materials, and WesterNet will respond as appropriate to these other activities as well. Nothing contained in this policy shall be construed to limit WesterNet's actions or remedies in any way with respect to any of the foregoing activities, including without limitation taking action to recover the costs and expenses of identifying offenders and removing them from the WesterNet service, and levying cancellation charges to cover to cover WesterNet's costs in the event of disconnection of dedicated access for the causes outlined above. In addition, WesterNet reserves at all times all rights and remedies available to it with respect to such activities at law or in equity.
